Privacy Policy

Business Spaces are Service Providers for the Consumer. When providing services to Consumers in our application, we are not responsible for the quality of services and fulfillment of obligations by third-party companies and/or Business Spaces. We are not responsible for transferring Consumers’ personal data to third parties, organized by the Owner of the Business Space. We are not responsible for transferring the Business Space Owner’s personal data to third parties organised by the Consumer.

User — a person who has downloaded and installed the ClubKit application and registered a personal account as a Business Space Member or Consumer.

Business Space Owner — The Business Persona, legal entity (company) or individual entrepreneur conducting commercial activities. The Business Space Owner is responsible for providing services to Consumers (subscribers) of its Business Space.

A Business Space Consumer or Member is a user who has received an invitation to a Business Space in the ClubKit app hosted by the Owner of this Business Space. The consumer becomes a ClubKit User and a Business Space Subscriber.

However, we are ready to accept complaints if you suspect Business Space and its Owner of fraud, poor service or non-performance of services. Subsequently, we will be ready to take appropriate actions to delete or block the account.

Privacy Policy

The developers of ClubKit by PNN Soft pay particular attention to protecting users’ personal information within the mobile application. We invite you to review the current Privacy Policy of the ClubKit application.

The document explains the rules and procedures for collecting, storing and processing personal information, how we share it with other people registered in the application, and your rights concerning this information. The Privacy Policy applies to all registered users of the ClubKit application (collectively Business Account Holders and Consumers, referred to as “Users”, “You”, or “Your”). The Privacy Policy is not intended to replace your rights under other laws in the sphere of data protection.

Before accessing and/or using the ClubKit app services, please read this privacy policy in detail to ensure you fully understand the applicable rules and procedures regarding the Personal Information about registered ClubKit users.

Which Personal Information the app collects

1.1. User Information

To be able to provide you with the ClubKit mobile app services on your device, we need to collect Personal Information. Personal information includes information that identifies an individual (personal data of an individual) and/or a legal entity for business account owners (business information). We collect the Personal Information you provide while using ClubKit.

  1. The information you provide to us while you create an account for the purpose of using the application as personal data of an individual, e.g. your first and last name, email address, and phone number. Users who register to create a Business Space and intend to use the ClubKit paid services purchase them under the terms of the Google Play and App Store platforms.
  2. The information that you provide to us as business information is specified by the Business Space Owners using the free/paid services of the ClubKit application. The abovementioned users enter business information at the stage of creating a new Business Space or editing a previously created Business Space (after registering a user account and verifying it). Business information includes Company name/Your name; Business email address; Legal address of registration of your business/company (optional); Taxpayer identification number (TIN), if available, and contact phone numbers.

We may collect aggregated information about the use of the application, e.g., Navigation information, Application Version number, and Crash Reports. Personal information that does not allow us to identify a person, e.g., Information about the activities in the application system; Information regarding the User’s device, Operating system, Internet browser, Screen resolution, Language and Keyboard settings, Date and Time.

Users who own a Business Account can invite the audience to the Business Space by posting invitations via social networks or forwarding the invitation to the user’s Private Space.

2. How ClubKit uses the abovementioned Personal Information

We utilise users’ personal and general information to provide the functionality of the ClubKit app to track app usage and, correspondingly, fulfill your requests. This results in improving the quality of the app and personalizing your experience.

The information that the User has provided as data of the physical person, we use for the following purposes:

  1. To create accounts and provide the ClubKit services. When registering through social networks, we get access to the account information that we use to create an account.
  2. To contact our Users by sending general or individual notices related to the application service, e.g. via emails, as well as informational messages.
  3. To update, expand and review our documentation and, correspondingly, identify new customers.
  4. To collect and store statistical data used for providing business spaces with analytics services in the Expert subscription. So that Business Space Owners will be able to evaluate the effectiveness of promoting goods/services.
  5. To provide the services of the support department in case of questions or problems related to the experience of using the ClubKit application.
  6. We need to use your Personal Information to provide the application functionality for ClubKit usage. We use personal information, such as your email address, to communicate with you. For example, we may send alerts about suspicious sign-in attempts on new devices and updates to our products.
  7. To track how users interact with the Business Space and provide analytics data in the corresponding tariff plan. In turn, Business Space Owners will be able to evaluate the effectiveness of promoting goods/services.

The information that Users have provided as business information we use for the following purposes:

  1. To create an account for your Business Space that will be available to consumers.
  2. To provide design services for your business space, e.g., storage of images and photo materials.
  3. To control restrictions on the distribution of certain goods and services groups. (For more details, see the User Agreement).
  4. To prevent fraud.
  5. To deliver services to those Consumers who have subscribed to the Business Spaces.
  6. To provide guarantees on the quality of service by the Owners of the Business Spaces to their Consumers.
  7. To provide contact information to Participants of the Business Space (here was a warning sign).

Users who have registered their accounts as Business Users provide Personal Information and Business Information (see Section #1). The specified information will be available to users who have received an invitation and become Subscribers or Consumers of the Business Space.

Users who registered an account as a Consumer provide only Personal Information (see Section #1). The specified information will be available to the Owners of the Business Accounts to which Consumers are subscribed to ensure the maintenance and provision of services by the Business Space.

Consumers cannot view the personal information about other Consumers. Also, consumers do not have access to those Business Spaces for which they have not received an invitation.

We use the aggregated information to check for updates to the ClubKit app on your device and provide you with an efficient experience.

3. Communication

3.1. Messages between users.

The ClubKit application allows Business Space Owners to exchange messages with Business Space Members. Messaging with other Business Space owners and Consumers who are not subscribers of a specific Business Space is not possible. The Business Space Owner can manage posts and comments.

Between themselves, participants in the Business Space can exchange public messages in the comments within the Business Space, to which they have subscribed, and only if the Owner has added the comment function.

3.2. Posts related to services and payments.

If you are a Business User subscribed to paid services, we may use your Personal Information to send you to email notifications, provide you with user support services, verify you as a new user, and confirm payment for ClubKit services.

We may also send you messages and content related to the services to the email address you provided during registration. We may send you promotional messages and content. You can easily opt out of receiving all promotional content by contacting us or canceling your subscription.

Google Play and App Store services regulate messages regarding payments for the application services and ClubKit. Cancellation of an already purchased tariff plan and/or change of the tariff plan is implemented through the Google Play and App Store services. 3.3. Your Rights Regarding Personal Information

ClubKit Developers agree that Users have the right to own and manage Personal Information, namely the ability to request access to their Personal Information, change, correct, delete or restrict their use of Personal Information.

Before fulfilling your request, we may ask you for additional information to verify your identity and security.

You are entitled to delete a Personal Account and a Business space. As further detailed in Section 8 for the retention of your personal information.

3.3.1. When we may share information with third parties

We may share your personal information with legal entities and individuals not associated with the ClubKit application as required by law.

3.4. Questions and complaints

If you have questions or concerns regarding the collection, use or disclosure of Personal Information, or if you think that the application does not comply with this Privacy Policy or current legislation on personal data protection, please contact us — our contact information is provided at the end of this Privacy Policy.

If you have complaints about the operation of the application related to the stability of its work, you can also contact us — our contact information is provided at the end of this Privacy Policy.

If you have suspicions about the fraudulent activity of the Business Space or the Consumer, or you have personally encountered a case of fraud, you can report it to the ClubKit support team. ClubKit developers detect, stop and prevent fraud and work on fixing technical or security issues.

4. Data storage

We retain your account and the data on it until your account is deactivated. In case of your account or Business Space deactivation, we may retain your Personal Information for no more than a month if you wish to restore your account and data in the application. After the specified period, the data is deleted and cannot be restored. You can deactivate the account by yourself, or we can do it if the application’s terms of use have been violated. 5. Security

We use various security measures to protect the personal information provided to us, both during transmission and once we receive it. However, no method of transmission over the Internet or via a mobile device or electronic storage method is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

5.1. Third-party website

Our application may contain links to other websites or services hosted by Business Users and consumers. We are not responsible for the privacy policies and procedures of the abovementioned sites or services.

5.2. Use of the application. Age restrictions

The Service is designed for a general audience, excluding users under the age of 18. We deliberately made it possible for Business Space Owners to set age verification for Subscribers/Consumers.

6. Changes to the Privacy Policy

We may revise the Privacy Policy from time to time. If we make changes to the Privacy Policy, we will notify you by email or by posting an in-app notice on the day the changes take effect. The privacy policy applies to all services provided by the ClubKit application.
